These Terms of Service ("Terms") govern your use of the Konstruction Group Inc. website and our construction services. By using our website or engaging our services, you agree to these Terms.

1. About Our Services

Konstruction Group Inc. is a construction subcontractor specializing in:

• Wood and metal stud framing
• Structural steel supply and installation
• Spray foam, batt, and blown-in insulation
• Drywall installation, taping, and finishing

We work with general contractors, builders, and homeowners who have the necessary permits and project coordination in place.

2. What We Do Not Provide

As a specialized trade subcontractor, we do not provide:

• Architectural or engineering design services
• Building permits or permit applications
• General contracting or project management
• Electrical, plumbing, or HVAC work
• Roofing, siding, or exterior finishes
• Windows, doors, or hardware installation
• Painting or interior finishing beyond drywall
• Foundation or concrete work
• Demolition services

These services must be arranged separately through licensed professionals.

3. Quotes and Estimates

All quotes and estimates provided by Konstruction Group Inc. are:

• Based on information provided: Quotes are prepared based on drawings, site visits, and information you provide. Actual conditions may differ.
• Valid for 30 days: Unless otherwise stated, quotes are valid for 30 days from the date issued.
• Subject to change: Final pricing may be adjusted based on actual site conditions, scope changes, material price fluctuations, or unforeseen circumstances discovered during work.
• Not a contract: A quote is not a binding contract until a formal agreement is signed by both parties.

4. Project Requirements

To begin work, the following must typically be in place:

• Valid building permits (obtained by you or your general contractor)
• Approved drawings and specifications
• Site access and readiness for our scope of work
• Signed contract and deposit (if applicable)
• Coordination with other trades as needed

5. Payment Terms

Payment terms are outlined in individual project contracts and may include:

• Deposit upon contract signing
• Progress payments at project milestones
• Final payment upon completion and inspection
• Payment due within 30 days of invoice unless otherwise agreed

Late payments may be subject to interest charges and may result in work stoppage. We reserve the right to file a construction lien for unpaid amounts as permitted by Ontario's Construction Act.

6. Workmanship Warranty

Konstruction Group Inc. provides a 1-year workmanship warranty on all completed work. This warranty covers:

• Defects in workmanship
• Work not performed to industry standards
• Structural issues caused by improper installation

This warranty does not cover:

• Normal wear and tear
• Damage caused by others, accidents, or natural disasters
• Issues arising from improper maintenance
• Problems caused by work performed by other contractors
• Material defects (covered by manufacturer warranties)
• Cosmetic issues reported after final inspection approval

7. Insurance

Konstruction Group Inc. maintains comprehensive insurance coverage including:

• $10 Million Commercial General Liability Insurance
• WSIB Coverage for all workers

Certificates of insurance are available upon request.

8. Limitation of Liability

To the maximum extent permitted by law, Konstruction Group Inc.'s total liability for any claim arising from our services shall not exceed the total amount paid for the specific work in question. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, delays caused by other parties, or damages arising from circumstances beyond our reasonable control.

9. Changes and Delays

Construction projects may experience changes or delays due to:

• Client-requested changes (will be quoted separately)
• Unforeseen site conditions
• Weather conditions
• Material availability
• Coordination with other trades
• Permit or inspection delays

We will communicate any significant changes or delays promptly. Change orders must be approved in writing before additional work begins.

10. Cancellation

If you need to cancel a project after a contract is signed, cancellation fees may apply to cover materials ordered, work completed, and scheduling impacts. Specific cancellation terms are outlined in individual project contracts.

11. Dispute Resolution

In the event of a dispute, we encourage open communication to reach a resolution. If a dispute cannot be resolved directly, both parties agree to attempt mediation before pursuing legal action. Any legal proceedings shall be conducted in the Province of Ontario, Canada.

12. Website Use

By using our website, you agree to:

• Provide accurate information in contact forms
• Not misuse the website or attempt unauthorized access
• Not reproduce or distribute website content without permission

Project photos on our website may depict work performed as a subcontractor. We may not have been the general contractor or sole contractor on these projects.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
